Ordering and Delivery

Order size and value:

Orders must be in complete case quantities.

UK mainland minimum order value £200 (excluding VAT). Export minimum order value £500.

Delivery:

UK mainland orders are delivered carriage paid.

UK non-mainland and export orders – we can use your freight forwarder or arrange delivery for you – charged at cost.

We aim to despatch all orders within 5 working days. However, at peak times please allow longer.

Out of stock items:

Every effort will be made to send your order complete, however should stock not be available, please note back orders over £75 (excluding VAT) are kept by Burgon & Ball for shipping when goods become available unless cancelled by the Buyer.

All back orders under £75 (excluding VAT) will be cancelled.

Discrepancies:

Any loss or damage to an order must be notified to Burgon & Ball, by email or fax, immediately on receipt of goods and also noted on the carrier’s receipt. Any shortages must be notified in writing to Burgon & Ball within 7 days.

Payment:

All first orders are payable on a proforma basis (payment by bank transfer) – unless credit references support the opening of a credit account.

Credit Accounts:

All new accounts are assessed for creditworthiness using credit agencies and publicly available information including trade references. If a limit cannot be approved, trade will commence on a proforma basis but can be reviewed at a later stage.

Retention of Title:

Risk in the goods passes from Burgon & Ball to the Buyer from the time of delivery of the goods to the Buyer or the Buyer’s carrier – whichever is earlier.

Title in the goods passes from Burgon & Ball to the Buyer on receipt of cleared funds for all of the goods – including any interest that may be payable under Clause 4.iv of the full terms & conditions.

Intellectual Property Rights:

Copyright in all images used in the Burgon & Ball catalogue and on the Burgon & Ball Dropbox lies with Burgon & Ball.

Images may only be reproduced with written permission from Burgon & Ball.

The name Burgon & Ball is trademarked and as such Burgon & Ball or Burgon and Ball cannot be used in full or in part, in any domain name of a website selling Burgon & Ball products.

Online Policy:

Customers must advise Burgon & Ball if they are ‘online-only’ in order that Burgon & Ball may monitor and control the number of such accounts.

Online-only customers shall advise Burgon & Ball of all websites on which they intend selling Burgon & Ball products.

Bricks & mortar customers with wholly-owned websites are permitted to sell Burgon & Ball products online without written permission.

Copyright for images containing Burgon & Ball products, produced with the intention of soliciting sales for those products, shall be deemed to lie with Burgon & Ball and its use without the written permission of Burgon & Ball shall be considered an infringement of that copyright.

Any customer found to be selling Burgon & Ball Products on third party websites without written permission is liable to have their account suspended and all outstanding orders cancelled.
